UGC has issued fresh guideline on territorial jurisdiction of universities

Hello Friends,

I know when you have opened this blogpost, you must be interested to know whether any university is violating and selling the degree to you.
As I told you earlier through my various post and warned, the same thing has happened. The summary of this guideline issued yesterday is as follows:

1. State government and central government universities: Within the jurisdiction as mentioned in their Act. (I have provided information of every distance learning institute with their territorial jurisdiction in previous post). This is ridiculous because many university's Act does not specify about the territorial jurisdiction for distance learning courses and a student cannot go through every university's Act. So technically, a state or central government university can offer courses anywhere in India with the condition that they should have their own employed staff over there (which hardly happens)

2. Deemed Universities: In the campus where they exist They cannot offer courses outside of it- examples are Shobhit, Bharti Vidyapeeth, D Y Patil and so on..

3. Private universities (like Amity, Jaipur National, Jodhpur National): not beyond the territory limit of the state where it is situation i.e. in its campus only

4. Private and deemed universities cannot affiliate any study centre, cannot start off campus centre

Mr.Govind,The fresh guidelines are similar to the old ones.Do you think by issuing guidelines only UGC can stop all this what is happening.Strict measures are required.After all these universities can not be allowed to play with the future of our students. UGC needs more power and honest people to run it. Honesty is very important if you want to bring the system back to the track. Guidelines are nothing but a formality to save your skin.

      I sent a mail to ministry of HRD and UGC complaining about 7 to 8 universities and UGC instead of holding inquiry, forwarded the letter to these universities. their reply and counter reply I have posted in my blog.
      UGC has has issued just circular and notification and did nothing for all these years. my worry is every day I see a new private university's advertisement on TV. and I see how these universities are involved in one after another degree scam. My this blog and blogpost is an effort to create awareness in mass.

    I don't think that issue of new guidelines will be a permanent solution for these degree scams, whats needed is a strong administration over these universities and a strict controll over these private universities, these few degree sellers should be closed or declared fake by UGC with immediate effect, so that it can be eye opener for similar ones

    1. Yes Taushik fully agree. These bodies including UGC are corrupt and they will not act against these errant private and state degree selling universities but finally student will suffer. Only after completing degrees, they will come to know about such guideline
      (UGC openly says and wash their hand that student should take due precaution about territorial jurisdiction before taking admission and UGC will not be responsible)
      Then why the hell do we need these bodies?
      I am posting it here so student should be remained well informed and they will not fall pray of such institute who are selling distance learning degrees. There are few private and deemed universities too who are acting well (example University of Mumbai, University of Pune, Delhi University, MAHER university to name few) but there are many who are just selling degrees and violating territorial jurisdiction. Above, I have provided link for the state wise list of universities where you can see that I have also provided territorial jurisdiction of each universities. Students must take admission within the territorial jurisdiction. Thumb rule: they can take admission blindly in central universities, they should take admission directly to universities in case of state university (no to centres and franchisee) and for private only in the city where they are situated

      There is no provision to surrender the degree unless law find/ university found that you have obtained the degree from wrong means (which liable to legal penal action)
      If you want that the college/ university should not use your name, you may send a legal notice of such effect to the college.
      There is no provision to abandon the degree or severe relationship with the institute for rightly obtained degree

    1. No, it is violation of territorial jurisdiction.

      For private job, it may work but for public sector job and for higher education, the degree becomes unacceptable.

      However if you enroll for the course and appear for exam in the any centres within jurisdiction of the university it stands valid.

      The Mdurai Kamraj University Act specify that it extends to the territory of district of Madurai, Ramnathapuram, Tirunelveli and Kanyakumari in the state of Tamil Nadu

      University does not have right and authority to ammend the Act, it has to be amended by the State legislature.

    5. Yes, when I wrote that blog, DEC was not dissolved and as soon as DEC dissolved, UGC take control over distance education and issued a new guideline. As per the new guideline, a state university has so strictly offer programme within their jurisdiction mentioned in the Act by which the university is established.
      Hence this changes applicable. If you apply to Madurai Kamraj University directly and appear for its all exam in University's main campus, the degree stands valid

      At first I must congratulate you for your outstanding effort for creating awareness against fake degree. I'm a victim of such a scam of PTU. In 2010 March I enrolled myself for the course of MSC-IT offered by PTU from Kolkata and that time I enquired about the validity of the degree from DEC Delhi, over the phone and they gave me green signal. In 2012, June after passing the final exam I got to know about the "Territorial Jurisdiction" issue and contacted PTU. PTU sent me a copy of letter issued by the DEC on the basis of 35th meeting of DEC held on 10th March, 2010 at New Delhi where it is clearly mentioned by DEC as follows:
      "The Council resolved that distance education and on-line education cannot have territorial jurisdiction and in case of Central and State universities, the territorial jurisdiction shall be as per the Act, Status and Distance Regulations of the respective universities for all their programmes...."

      Now according to PTU as I took admission before the new regulation was passed my degree is valid. Is it true?

      It says as per the "Act"
      DEc has cancelled recognition of PTU in 2012 and in 2013 DEC dissolved and UGC took over responsibility of granting permission to distance learning institutes (its a complete mess). And then they issued this guideline (mentioned in your case).

      Considering your example and as per the Act of the PTU Act it is allowed to offer all courses within Punjab only. If you read further, even government ordered action against PTU vice chancellor.
      If you are from Punjab or if you have attended exams anywhere in Punjab through its own centre then your degree standa valid however distance learning obtained through appearing exam in the franchisee ran study centre stands invalid.

    1. Hi,
      This is newly established recognized private open university in Arunachal.
      In my view, government should not allow to establish a private open university. Only government should look into such aspects.
      Second, since it is a private university, it cannot offer any course outside the city where it is situated.
      However, I have started getting queries from people and it seems this is also doing commercialisation of education and offering courses outside the city where it is situated. Students need to keep in mind that this is violation of UGC guideline on private universities as well as territorial jurisdiction. This university will make money but finally a student has to suffer as such qualification stands invalid.

    1. I am correct in this matter. State Open Universities are established for promoting non formal education system in the particular state and UGC guideline says not beyond the boundary of the state in terms of territorial jurisdiction. And further, the matter is "deemed" in the Act. UGC has also put restriction on franchising of study centre to any universities. KSOU's all centre within and outside the states are in franchisee model which violates UGC guidelines.

      Students may ask for refund of the fee or produce letter from the UGC stating that PTU's qualifications obtained outside states are also valid.

  10. I am a hotel management graduate from a private institute in kolkata which was affiliated to ptu...so now I can't go for MBA in the same field abroad? Or is it that My degree is invalid only for higher education and govt. Jobs in India?
    So I have to start afresh? even if I want to go abroad?(undergraduate).
    Pls help..really confused and frustrated.

      Do not need to get panicked if you have completed the degree before 2013.
      You should apply to the universities where you are intended to apply then see their responses. They should accept you.

      Please note that the matter of territorial jurisdiction is applicable from 2013 onwards only when DEC get dissolved and UGC took control over it.
      DEC, in 2010 decided that distance education cannot have territorial jurisdiction

      If he has done it through university then there is no need to worry.
      However, NCTE has granted permission to limited universities to conduct B.Ed with the condition to offer the courses to in service teacher of the home state only.
      In this case, it is surprise to know how the state government allowed job on the basis of that and if they have allowed, then there is no question of taking action now.
      Anyway, you should wait and watch the result

      1. The courses is not offered through any private agency or any franchisee agreement
      It must have been offered by university's own regional centre/ study centre with its own appointed staff who are capable of handling administration and examination

      If you are doing a full time on campus degree at Jaipur national, no need to worry
      If you are doing distance learning (except management, engineering and Ph.D) from there and appearing for exam there only at their campus at Jaipur again no need to worry

      But for distance learning courses, short degrees you need to worry a lot

University sells degrees officially too and to name few of them are EIILM, CMJ, MGU, Swami Vivekanad, CV Raman, Monad, Shridhar, Technoglobal etc. When inquery happens then they refuse to accept it stating they have not issued such degrees. One should always choose a reliable and a well reputed universities

    First, I wud appreciate your effort for spreading awareness in society against such money making firms. I have read lots of your blogs which are very useful.

    I have question for you. And I m pretty sure that you will answer my question. Unfortunately, me too also cheated by one of money making firm. I have completed my bcom graduation from MGU Meghalya thru distance mode. And, I was not aware of such territorial jurisdiction act.
    Now, pls pls suggest me what to do next? As I am planning to go for PG in MCA. Plz suggest is MGU degree valid for taking admission in any state university for MCA. Also, I am working so not able to go for Full time course. Then in that case which will be the best University for me to go further without any. such issues. Also, plz confirm abt the Annamalai University thru distance mode. They have regional centre in delhi, which is mention in the university website. Can i opt go with this university. Dnt know wheather they have permission to provide MCA thru distance mode or not. Also, how anyone can know about the university territorial jurisdiction before taking admission.

      Above guideline is for distance education
      For regular programmes, a deemed university has to strictly offer courses from its campus only. To start any new off campus centre, it has to take prior approval from UGC
      As far as Amrita Vishwa vidyapeetham concern, it is a A rated university by NAAC
      Its Kochi campus is not approved by UGC, its Bangalore and Mysore campuses are also not approved UGC. So far only its Coimbatore campus has UGC approval (need to re-verify with UGC)

  34. Hi govind. Nice job by you. As I did my postgraduate from viswa bharti university raipur in year 2004 to 2006. The university is denotified. The qualification became not valid. Is that valid and how to get attested from mhrd. The supreme court stated that during my studies year are valid. Now university website is not there.campus is not there. Wat should I do now. Plz kindly help me on this.

      unfortunately degrees of all those 100+ private universities are invalid as per supreme court judgment. I doubt attestation will happen. Few universities restarted with new Act amendment such as C V Raman (and it is still selling the degree). Please check education department of Chhatisgarh Government

  37. no. SMU does not have DEB recognition and being a private university, it cannot offer any course outside its campus in Sikkim. Also, the MCA distance programme does not have AICTE approval.

    I passed 10+2 on 1999 after that i joined in a Btech College in 1st year i got 4 supply and 2nd year i got 4 supply. i tried my best to clear my supplies but i failed. 2003 i left it.

    now its 2015 di u suggest me to buy any one sitting degree. you may ask why i need degree now. bcoz my office asking me for graduation.

    1. Sorry, I do not think I should respond to this query. I do not support any of such degree buying practices. Just as a word of caution, such degree will be fake and you will be in bigger trouble. Better, opt a graduation subject you like of 3 years duration in distance and online mode, complete it. It may take longer time but will give you a peaceful life

  42. Conflict between UGC act about jurisdiction area of universities and Karnataka State Open University. Karnataka State Open University clearly mention about area of its jurisdiction area. Karnataka act NNo.46 of 1994 CHAPTER 2nd (3).2.The head quaters of the university shall be at such place as may be specified by the government by notification and it may establish,maintain or recognise collages,regional centres and study centres at such places in Karnataka and may also open centres outside Karnataka at such places as it deems fit.

    1. Even the state government was against KSOU VC, apart from this, KSOU violated UGC guideline including not to appoint any private body as study centre. Further, whatever you have mentioned above, thats true, but UGC's guidelines and Supreme Court Judgment in Prof. Yashpal Vs Chhatisgarh remains supreme. Only state legislature could rectified the Act and could provide clarity. One cannot deny scam in KSOU and many such universities.

    1. Where you live it does not matter if you have not done anything ethically wrong or not violated any rules. If it is a full time degree obtained from the campus then no problem. However, distance education BCA of NIMS does not have approval.
      It is authorised to offer distance education from head quarters only

  45. Govind sir I was not advocating KSOU. And I am against all degree selling peoples. But I was reading the law passed by Karnataka government. And that wrot even study centres and regional centres in chapter 1.definition. I am not good in laws. I was searching for Master Degree with decent university but I got warste experience in it and found every one is selling degrees. Even PU too. So now I am going to give up to take admission.

      Please do not give up. Everybody is not selling degrees. In my vast experience in distance and open learning area, I found few universities are really doing great in distance learning, sometime their officers did corruption but university at large, no. Examples are

    As par this link, territorial jurisdiction will be implemented from 2014-15 academic year. Or its applicable from 27 june 2013.
    If we believe this news students completed their graduation before 2013, thier degrees are valid.

      The link is talking about implementation of Madhavan committee report. No, if students have completed such degree in 2013 by violating territorial jurisdiction, then such degrees are invalid for government job.

    I have a query. I took admission in BA in ICDEOL (distance), Himanchal Pradesh University in 2008. I applied for the first year exams but one month before the exams i was infected with tuberculosis of the spine. Due to the immense pain, I could not write the exams and could not continue the studies. The treatment lasted for about 18 months and after I had recovered I decided to continue my studies. In the year 2010, I enquired about various universities and during the enquiry process I went to a study centre of Periyar University in Delhi. The staff there told me that the university could give me admission into BA 2nd year on the basis of my first year examination admit card that I got from HP university on the condition that I would have to write all the first year exams along with the second year exams from Periyar university. They termed this provision as 'condonation of break in studies'. I thought this way I would not have to start from the beginning and could save one precious year and took admission in BA 2nd year in Periyar. I completed my degree in 2012. Now i have cleared a written test of a Govt. service and the interview is due in May. I just wanted to know if my degree is valid. Your help will be appreciated.

    PS: Right after I had got my provisional certificate, i sent it for verification through a private firm.. it was verified clear by the registrar of the univ.

    1. Your degree should be valid. If you face problem, that will be only due to Territorial Jurisdiction violation (if they ask). At the time of interview, do not reveal that you have cleared it from Delhi centre and nowhere in your certificate should say it was from Delhi centre. All the best

    1. No, although DEC stated that state should have control on this. In fact UGC asked all state government to amend their universities Act and not to allow any state universities to offer courses beyond the state

      This is due to corruption in UGC as well as esrtwhile DEC, knowing the problem, they never stepped in to stop. DEC chairman and officers took huge bribe to have such anomalies and and everybody in the government interpreting it in their own way. Prof. Yashpal's case has clearly laid down territorial jurisdiction and DEB adopted, clarified it in 2013. You should not think about it and prepare for your preparation. Let the authority decide it clearly.

Sir,it is clear that march 2010 to 2012 December dec decided in 35 th meeting that distance education can not have territorial jurisdiction for state and central govt university can offer programs through distance mode by their own rule,when dec devolve then 2013 onwards current rule is going..on,and upto 2012 dec is the soul body for distance education by parliament act,and sc vardict on 2005 is for regular course and private university and off campus,then why you say that distance education is not valid from periyar university(pride) in the session 2010 to 2012 from university authorised study centre out of state?sc order in the year 2006 for same issue is favourable for ptu,

      Technically, territorial jurisdiction is valid from 2010 onwards as before DEB, DEB also cancelled its earlier order and decided that there should be territorial jurisdiction. State universities in south India and PTU has compromised a lot by partnering with private people to open study centre and compromised a lot with quality as these centres were involved in malpractices

    1. yes, the degree is invalid as after Prof. Yashpal Vs State of Chhatisgarh case, it was clarified by the supreme court and UGC that under any case a private university cannot offer any course outside its campus.
      However, DEC never came with any such circular and always created chaos and confusion due to corruption in UGC, DEC including then IGNOU VC V Rajashekharan Pillai, no harm happened to them and students, specially those in government sector jobs are suffering a lot

Sir it is a private university and offer distance education and its area is only their state. If a person of up, mp or any state got degree from this university after three years of study in ba/bsc general/bcom. Is their degree valid for gov job or higher study. Sir i know that mgu has no power to give degree outside meghalaya. But only student permanent address is outside meghalaya how anyone say that degree is not valid may be during their study he resides in meghalaya. Sir my question is very simple how any authority can say that their degree is invalid only why he is outsider. Sir today lots of student facing problem by this rule. Sir this rule against the meaning of distance education. Every student of private university not buy their degree may be he earns their degree after study of three years.     1. if it is a full time BA/ B.Com or B.Sc. on campus degree, it is fully valid for any state or central government job and for higher education.
      Any authority cannot say that the degree is invalid as a native student has only to do the course, nothing such rule exist. There is no such rule and such students can file RTI application.

Having discussed a lot about the territorial jurisdiction of State Private University, the public came to know about such an issue only when UGC issued circular dated 27th June 2013 and media widely covered this issue. Now, the students all over India are aware of the territorial jurisdiction and are very cautious while taking admissions for a course through distance mode.

    Now the ultimate question is: "Whether the degrees offered by State Private University through distance mode till 2012 is valid or not?" If such degrees are NOT valid, then it is shame on the education system in India.

    UGC should insert a chapter in the high school level education about the different types of Universities functioning in India and the validity of the courses. So that, it will be helpful for the students to be careful while choosing a distance education course after schooling.

    In this regard, I have already sent letters to UGC to decide on introducing a chapter about the Higher Education System in India at school level

    1. I agree to you. I had a long debate with then IGNOU Director Prof. Nalini Lele and she replied in absolutely not acceptable way "It is student who is responsible to take care that a university has all necessary approval and complying"
      Still, many students are not aware about the conditions applied to a university while offering non regular programme.

      No, in Prf. Yashpal Vs State of Chhatisgarh, SC clarified that a private and deemed university should not offer coure beyond their campus and UGC repeatedly reminded universities about it, but never brought this to public domain (possibly, owing a lot to these degree scamster in forms of bribe)

      Yes, In India, a degree is not obtained for knowledge and for education, it is just a stamp you need to show to the world either for job, for marriage or to show you are "educated"

      A good suggestion, but UGC does not do anything. I have exposed 100+ fake universities but UGC still sticking to its 22 universities list only. They never scanned, never carried investigation.

  70. Continuous News are coming from various states about mass copying in regular courses in universities. Even in MP a famous state university involve in altering numbers in marksheet in some amount and by power politicians. A guy who got 26 in answersheet get 62 in marlsheet, this happen here. people consider such type degree valid and as per rules But skilled people do distance learning they impose unnecessary rules. Thats why India has more than 55% entrepreneurs who are not even graduates and graduates from good university working under them and the same reason we listen in HR forums that in India most of graduates are employable. Chance and opportunities should be given to those who are skilled and talented irrespective of which university he pursued, it was off campus or on campus and what degree he have. Online degrees in US are valid everywhere and that country is more develop than Indian who has somany rules and It will remain developing till jobs are not given to skilled people.

      Annamalai does not have UGC approval so far for distance education and even if it gets approval, it has to give undertaking to UGC stating it will not offer course beyond its territory

      You have IGNOU as a better option. If you are looking for MBA, then opt Pondicherry

      If you are least bothered about government recognition, you may go ahead with Annamalai University

  81. i did my diploma in civil engineering from state private university recognised by ugc under ugc act 2(f) named monad university uttarpradesh in regular mode its a university so does not need any aicte affiliation because it is a university and i have studied in university campus .

  103. Sir I have enrolled in 2010 in manonmaniam sunderner university tamilnadu in ma eng through study centre in haryana and completed in 2012. BT due to less marks I made revolution and and completed in 2013. Sir is this degree valid for govt jobs in haryana.plz rply

  112. Hello sir I have done BCA from makhanlal chaturvedi university Bhopal in 2004 through study center established in punjab; Is ugc new rule of jurrisdiction effect me or not

    Also this university writes in their act that it has nationalwide jurrisdiction ;
    all the courses done through study centers (any where in India) comes in the category of regular mode; kindly Give your view
